The Party Wall Act lays out the rights and responsibilities of owners who are carrying out works and provides protection to Adjoining Owners.
The Party Wall Surveyor is responsible for examining the proposed works, ensuring the designs follow the act and will have no impact on the adjoining owners property. In the unlikely event of damage, Party Wall Surveyors can support you to come to an agreement with your neighbour – should that not be possible, an award for damages can be made.
The Act also may grant access rights to both Party Wall Surveyors and building owners, allowing surveyors to conduct all necessary inspections and building owners and their builders to potentially access the adjoining owner’s land and may include the erection of scaffolding.

Who needs a Party Wall Surveyor?
Line of Junction
If you are completing any building works and building up to the Line of Junction (Boundary Line), then Notice should be served on your neighbour to ensure your legal responsibilities are met.
Loft Conversion
Should you be undertaking a loft conversion and are a semi-detached or terraced property, you are required to serve notice on your attached neighbours. Serving notice avoids any disputes between neighbours and ensures a smooth building process.
Ground Floor Extension
If you are completing a Front, Side or Rear Extension and your property is within 3 metres of your neighbour’s structure or wall with the possibility of going lower than your neighbour’s foundations, then notice is required to be served upon your neighbour. This will significantly reduce your potential risk.
