Section 6 Notice:
Excavation Works

Our Section 6 Notice service for Excavation Works is designed to facilitate legal compliance and mitigate potential risks associated with excavation near adjoining properties. We manage the entire notification process, from preparing and serving the notices to coordinating discussions with affected neighbours. Our experienced team ensures that all necessary information regarding the excavation works, including depth, location, and potential impacts, is clearly communicated to adjoining property owners in accordance with the Party Wall etc Act 1996. By fostering transparent communication and addressing concerns upfront, we aim to minimise disruptions and ensure that excavation projects proceed smoothly and in accordance with regulatory requirements, protecting the interests of all parties involved.

Why is a Section 6 Notice needed?

Legal Compliance

We handle the entire process of issuing Section 6 Notices in accordance with the Party Wall etc. Act 1996, ensuring that property owners adjacent to excavation sites are informed about planned works and potential impacts on their properties.

Detailed Communication

Our service includes providing comprehensive details about the excavation works, such as depth, location, and anticipated duration, to neighboring property owners. This transparency helps to clarify any potential concerns or questions they may have.

Risk Mitigation

By proactively notifying adjoining owners and engaging in dialogue, we aim to mitigate risks associated with excavation, such as ground settlement or structural impacts, and address any specific requirements or agreements that may be necessary.

Who needs a Party Wall Surveyor?

Line of Junction

If you are completing any building works and building up to the Line of Junction (Boundary Line), then Notice should be served on your neighbour to ensure your legal responsibilities are met.

Loft Conversion

Should you be undertaking a loft conversion and are a semi-detached or terraced property, you are required to serve notice on your attached neighbours. Serving notice avoids any disputes between neighbours and ensures a smooth building process.

Ground Floor Extension

If you are completing a Front, Side or Rear Extension and your property is within 3 metres of your neighbour’s structure or wall with the possibility of going lower than your neighbour’s foundations, then notice is required to be served upon your neighbour. This will significantly reduce your potential risk.
